I have paid state taxes in more than one state this year. How do take care of the situation?
Q. I have NM state taxes withheld from my pension. This year I also worked in CO and state taxes were withheld there. Will I have to pay state tax on the $ earned in CO in NM and will I have to try to recover that CO $ by filing a tax return in both NM and CO?

A. How you file will depend upon where your legal residence was. If you lived in both states for part of the year you'll file part-year returns in both states listing only the income earned in each state while you lived there. If NM taxes were withheld on the entire pension you'll have to prorate the income and apportion it between the two states. NM will generally only be entitled to tax it while you were a legal resident there and then CO will pick up for the time you lived there. If your legal residence was in only one state but you had income from both then it gets slightly messier. Since you had NM state taxes withheld from your pension, I'll go on the assumption that you're a legal resident of NM who also worked in CO. You'll first… [cont.]

Does a state tax refund take longer to get back than a federal?
Q. I'm from ND and I finled my taxes by E-file. I've received my federal refund on Good Friday, but I haven't gotten my state back yet. Has this happened to anyone else? I checked my status on our state tax commissioner website and it says it's been received and being processed. Do state refunds usually take longer than a federal?

How long do you have to live in a different state to pay in-state tuition?
Q. I live in Pennsylvania. I'm a junior in high school and I would like to travel out of-state for college. However, out of-state tuition for public schools is more than it is for in-state schools. My question is, if I attended an out of-state school freshman year then got an apartment there for sophomore year-senior year, would I be able to pay in-state tuition? If not, then can anyone tell me how long I'd have to live in that state to pay in-state tuition? Thanks!

A. As long as you moved to another state for the purpose of going to college, you will never be deemed an in state resident. Also as someone else stated, you can't be in school during the time you are using to gain residency. Lots of folks make the assumption as you do, that after a year or two they will be switched to in state. This is simply NOT the case. It's pretty much a "once an out of state resident, always an out of state resident". Also note there are many more things you would have to do than simply living there. The hardest for most kids is be 100% self supporting and working full time, new drivers licence, voter ID, library card, buy a house perhaps or sign a lease... re-tag your car, maintain your own insurance on your own… [cont.]
